This document is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediary Guidelines) Rules, 2011, which require publishing the rules and regulations, privacy policy, and terms of use for access or usage of the domain name https://www.intellectsprouts.com (“Website”), including the related mobile site and mobile application (collectively referred to as the “Platform”).

The Platform is owned by IntellectSprouts, having its registered office at Gautam Buddha Nagar, Uttar Pradesh, India (hereinafter referred to as the “Platform Owner”, “we”, “us”, or “our”).

Your access to, browsing of, or use of the Platform and its services (“Services”) is governed by these Terms & Conditions (“Terms of Use”) along with the applicable policies, including the Privacy Policy, No Refund Policy, Shipping Policy, and Replacement Policy, which are incorporated herein by reference.

Your use of the Platform and Services is entirely at your own risk, and you are responsible for independently assessing whether the Services meet your requirements.

For the purpose of these Terms of Use, wherever the context so requires, “you”, “your”, or “user” shall mean any natural or legal person who accesses or uses the Platform.

1. IntellectSprouts: Refers to the organization managing competitions, products, and related services.
2. Participant: Any individual or entity that registers for and/or participates in our competitions.
3. User: Anyone who accesses our website or engages with our services, including participants and customers.
4. Submission: Any content provided by participants, including photographs, videos, artworks, writings, or other materials.

Eligibility:

• Competitions are open to participants meeting the specified age, residency, or other eligibility criteria outlined for each event.
• For participants under the age of 18, parental or guardian consent is mandatory.

Submission Requirements:

• All submissions must be original and created by the participant.
• Submissions must adhere to the guidelines and themes specified for each competition.
• Submissions must not infringe on any third-party intellectual property rights or violate any laws.

Judging and Results:

• All decisions made by the judging panel are final and binding.
• Winners may receive gifts, medals, trophies, or other awards at the discretion of IntellectSprouts.

Fees:

• IntellectSprouts reserves the right to charge registration fees for competitions. Such fees are non-refundable unless otherwise stated.

By participating, you grant IntellectSprouts a non-exclusive, royalty-free, perpetual right to use, reproduce, distribute, and display your submissions across all media platforms, including but not limited to websites, social media, and promotional materials.

IntellectSprouts reserves the right to modify or edit submissions for promotional purposes while maintaining the original essence of the content.

Participants can withdraw consent for promotional use by contacting IntellectSprouts, understanding that previously shared content may remain accessible on public platforms.

Product Sales:

• IntellectSprouts may sell educational and creativity-related products. All product prices are inclusive of applicable taxes unless specified otherwise.

Shipping Policy:

• Shipping charges apply to all product purchases and competition deliveries unless stated otherwise.
• Winners of competitions may receive their awards without incurring shipping costs; however, IntellectSprouts reserves the right to decide on the mode of delivery.
• Certificates will be provided digitally. Hard copies are available upon request, subject to printing and shipping charges borne by the requester.

Returns and Refunds:

• Products are eligible for return or refund only in cases of defects or incorrect items delivered. Requests must be initiated within 7 days of delivery.
• Refunds for registration fees are not permitted unless a competition is canceled by IntellectSprouts.

You agree to pay all charges applicable for availing the Services as displayed on the Platform. All payments are subject to applicable policies, including the No Refund Policy.

• Users and participants must behave respectfully towards IntellectSprouts staff, judges, and other participants.
• Any form of cheating, plagiarism, or fraudulent activity will result in disqualification and potential bans from future competitions.
• IntellectSprouts reserves the right to terminate a user's access or participation for violations of these terms.

• All content, including text, graphics, logos, and software on the IntellectSprouts website, is the intellectual property of IntellectSprouts and protected under copyright laws.
• Users may not reproduce, distribute, or create derivative works from the website's content without prior written permission.

• IntellectSprouts is not liable for any loss or damage resulting from the misuse of its website or services.
• Delays or disruptions in services caused by external factors, including technical issues or force majeure events.
• Users agree to indemnify IntellectSprouts against any claims, damages, or expenses arising from their use of the services or submissions.

The Platform may contain links to third-party websites. Accessing such websites will be governed by their respective terms and policies. The Platform Owner is not responsible for the content or practices of such third-party websites.

Your use of our services is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information. By using our services, you consent to the practices described in the Privacy Policy.

You agree to indemnify and hold harmless the Platform Owner, its affiliates, officers, directors, agents, and employees from any claim, demand, loss, or penalty arising out of your breach of these Terms, Privacy Policy, or applicable laws, or violation of third-party rights.

The Platform Owner shall not be liable for failure or delay in performance due to events beyond reasonable control, including natural disasters, governmental actions, or technical failures.

These Terms of Use shall be governed by and construed in accordance with the laws of India.

All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at Gautam Buddha Nagar, Uttar Pradesh, India.

IntellectSprouts reserves the right to modify these Terms and Conditions at any time. Users will be notified of significant changes through our website or registered contact details. Continued use of services after modifications constitutes acceptance of the revised terms.
